TERMS OF USE FOR DIMITTS EMPLOYMENT PORTAL

1. INTRODUCTION

Welcome to the Dimitts Integrated Nigeria Employment Portal ("Portal"), operated by Dimitts Integrated Nigeria ("Dimitts", "we", "us", or "our").

The Portal provides a digital platform through which employers may advertise employment opportunities, identify and manage prospective candidates, and manage employee information, while job seekers and prospective employees may create profiles, upload CVs, search for vacancies and apply for employment opportunities.

These Terms of Use ("Terms") govern your access to and use of the Portal and all related services.

By creating an account, accessing the Portal, posting a vacancy, submitting an application or otherwise using the Portal, you confirm that you have read, understood and agreed to these Terms.

If you do not agree with these Terms, you should not create an account or use the Portal.

 

2. DEFINITIONS

For purposes of these Terms:

"Employer" means any company, organisation, business, government entity, institution, recruiter or authorised representative using the Portal to advertise vacancies, recruit candidates or manage employee information.

"Job Seeker" means an individual who creates an account, searches for employment opportunities, submits a CV or applies for a vacancy through the Portal.

"Candidate" means a Job Seeker who applies for, or is being considered for, an employment opportunity.

"Employer Account" means an account created by an Employer to access recruitment and employee-management features.

"Job Seeker Account" means an account created by an individual seeking employment.

"Content" means information, text, photographs, CVs, job descriptions, documents, logos, images and other materials uploaded or submitted through the Portal.

"Portal" means the Dimitts website, employment portal, employer portal, candidate portal and related digital services.

 

3. ELIGIBILITY

3.1 Employers

An Employer registering on the Portal represents that:

• it is a legally recognised business, organisation or entity, or is duly authorised to act on behalf of one;
• the information provided during registration is accurate and current;
• the person creating the account has authority to represent the Employer;
• the Employer will comply with applicable Nigerian laws and regulations; and
• all vacancies posted are genuine and relate to actual employment, internship, contract or other legitimate opportunities.

3.2 Job Seekers

A Job Seeker represents that:

• the information supplied to Dimitts is accurate and not deliberately misleading;
• information contained in their CV and applications is truthful to the best of their knowledge;
• they will not impersonate another person;
• they will not submit fraudulent qualifications or employment history; and
• they will comply with applicable laws and these Terms.

Where a user is below the applicable legal age for employment, the user must comply with all applicable laws and restrictions concerning employment.

 

4. ACCOUNT REGISTRATION

Users may be required to create an account to access certain Portal features.

Users are responsible for:

• providing accurate registration information;
• maintaining the confidentiality of their login credentials;
• keeping their account information updated;
• preventing unauthorised access to their account; and
• notifying Dimitts promptly where they suspect unauthorised access.

Each account should be used only for its intended purpose. Users must not create accounts using false identities or misleading information.

Dimitts reserves the right to suspend or terminate accounts containing false, misleading or fraudulent information.

 

5. EMPLOYER SERVICES

Employers may use the Portal to:

• create and manage their employer profile;
• post job vacancies;
• receive and review applications;
• shortlist candidates;
• communicate with candidates;
• manage recruitment activities;
• maintain employee information;
• organise employee records through the employer portal;
• manage their workforce through a central employee database; and
• access other recruitment or workforce-management services made available by Dimitts.

Employers are solely responsible for the accuracy and legality of information contained in their job advertisements.

 

6. EMPLOYER SUBSCRIPTION AND JOB POSTINGS

Where applicable, an Employer may subscribe to Dimitts' annual employer package.

Dimitts shall from time to time specify the employer subscription amount payable by any employer who wishes to use the site. An Employer will not be permitted to post job until the subscription fee has been paid.

Subject to the applicable package:

• Employers may post an unlimited number of vacancies during the subscription period;
• job vacancies may be promoted through Dimitts' available communication and marketing channels;
• Employers may independently review and manage applications; and
• Employers may access applicable employee-management features.

Dimitts reserves the right to modify its pricing, packages or available features. Any material changes to subscription terms will be communicated through appropriate channels.

Unless otherwise stated, subscription fees are for access to the applicable Portal services and do not constitute a guarantee that an Employer will receive a specific number of applications, interviews or successful hires. In the cases of violation of this “terms of use” or any part of the privacy policy, Dimitts reserves the right to withdraw a job post or suspend an employer’s account and no refunds of the subscription fee will apply.

 

7. RESPONSIBILITIES OF EMPLOYERS

Employers agree that they will:

1. Post only genuine and legitimate employment opportunities.
2. Provide accurate job descriptions, qualifications, remuneration information where appropriate, location and other relevant details.
3. Not use the Portal to advertise fraudulent, illegal, discriminatory or deceptive employment opportunities.
4. Not request inappropriate fees from candidates as a condition of employment.
5. Not impersonate another organisation or individual.
6. Not use candidate information for purposes unrelated to legitimate recruitment or lawful employment management.
7. Treat candidate information confidentially.
8. Comply with applicable employment, anti-discrimination, data-protection and other relevant laws.
9. Obtain any necessary consent or lawful basis required for processing employee or candidate information.
10. Promptly remove vacancies that are no longer available.
11. Keep employee information reasonably accurate and up to date.
12. Take reasonable measures to prevent unauthorised access to employee and candidate information.

 

8. JOB SEEKER SERVICES

Job Seekers may use the Portal to:

• create a professional profile;
• upload or update their CV;
• search for available vacancies;
• apply for advertised positions;
• communicate with Employers where the relevant feature is available;
• receive information concerning relevant employment opportunities; and
• manage their applications and profile information.

Dimitts does not guarantee that registration or application through the Portal will result in employment.

 

9. RESPONSIBILITIES OF JOB SEEKERS

Job Seekers agree to:

• provide truthful and accurate information;
• submit genuine qualifications and credentials;
• avoid submitting fraudulent CVs or documents;
• avoid impersonating another person;
• avoid applying using another person's account;
• refrain from abusive, threatening or inappropriate communication;
• refrain from attempting to obtain employment through fraudulent means;
• protect their account credentials; and
• promptly update inaccurate or outdated information.

Submitting false qualifications, fraudulent documents or misleading employment information may result in account suspension or termination and may be reported to appropriate authorities where required.

 

10. JOB ADVERTISEMENTS AND RECRUITMENT DECISIONS

Dimitts provides a platform that facilitates interaction between Employers and Job Seekers.

Unless expressly stated otherwise, Dimitts is not the employer of candidates applying for vacancies posted by third-party Employers.

Employers are responsible for:

• evaluating candidates;
• conducting interviews;
• verifying qualifications and references;
• making employment decisions;
• negotiating employment terms;
• issuing employment contracts; and
• complying with applicable employment laws.

Dimitts does not guarantee the accuracy of every job advertisement submitted by an Employer and does not guarantee the suitability of any particular candidate.

Where appropriate, Dimitts may review, reject, edit, suspend or remove a vacancy that appears fraudulent, misleading, unlawful, discriminatory or inconsistent with these Terms.

Dimitts may refuse to advertise any vacancy found to be harmful, offensive, misleading, suspicious, unlawful, fraudulent or inconsistent with any known public law.

 

11. EMPLOYEE MANAGEMENT PORTAL

Where an Employer uses the employee-management features, the Employer acknowledges that it is responsible for the employee information it uploads, stores or manages through the Portal.

Employers must ensure that:

• information uploaded is accurate and lawfully obtained;
• employee information is processed for legitimate purposes;
• access is restricted to authorised personnel;
• employee information is not unlawfully disclosed; and
• employee records are managed in accordance with applicable data-protection requirements.

Dimitts may provide the technological infrastructure for storing and managing employee records but does not assume responsibility for an Employer's underlying employment relationship with its employees.

 

12. DATA PROTECTION AND PRIVACY

Dimitts recognises the importance of protecting personal information submitted through the Portal.

Personal data may include, among other information:

• names;
• contact details;
• CVs;
• educational qualifications;
• employment history;
• professional certifications;
• photographs;
• identification information;
• application information; and
• employee records.

Dimitts will process personal information in accordance with its Privacy Policy and applicable data-protection laws, including the Nigeria Data Protection Act 2023 and applicable regulatory guidance. The Nigeria Data Protection Commission identifies lawful, fair and transparent processing and privacy by design/default among the relevant data-protection principles.

Users should read Dimitts' Privacy Policy carefully to understand:

• what information is collected;
• why it is collected;
• how it is used;
• who may receive it;
• how long it may be retained;
• applicable data-subject rights; and
• how privacy-related complaints may be submitted.

Employers are responsible for ensuring that any personal information they upload or process through the Portal is handled lawfully.

 

13. CV AND PERSONAL INFORMATION VISIBILITY

By submitting a CV or professional profile for recruitment purposes, a Job Seeker understands that relevant information may be made available to Employers or other authorised users for legitimate recruitment purposes, subject to the Portal's privacy settings and Privacy Policy.

Job Seekers should avoid including unnecessary sensitive personal information in publicly accessible CVs or profiles.

Dimitts may restrict or remove information where it reasonably believes that such information creates a security, privacy, legal or regulatory risk.

 

14. COMMUNICATION BETWEEN EMPLOYERS AND JOB SEEKERS

The Portal may provide communication tools to facilitate recruitment.

Users agree to use these tools only for legitimate professional purposes.

Users must not use the Portal to:

• harass or threaten another user;
• send spam or unsolicited promotional messages;
• distribute malware or malicious links;
• solicit unlawful payments;
• engage in fraud;
• distribute sexually explicit or offensive material;
• discriminate against another person; or
• engage in any unlawful activity.

 

15. PROHIBITED JOB ADVERTISEMENTS

Employers must not use the Portal to advertise:

• fraudulent employment opportunities;
• jobs requiring unlawful payments from applicants;
• pyramid schemes or deceptive investment opportunities;
• illegal activities;
• discriminatory employment opportunities prohibited by applicable law;
• vacancies containing materially false information;
• opportunities designed to obtain personal information for fraudulent purposes; or
• any position that violates applicable Nigerian law.

Dimitts may remove any such advertisement without prior notice.

 

16. INTELLECTUAL PROPERTY

Unless otherwise stated, the Dimitts name, logo, website design, trademarks, graphics, software, text, layout and other original Portal materials belong to or are licensed to Dimitts.

Users may not reproduce, modify, distribute, sell, commercially exploit or otherwise use Dimitts' intellectual property without prior written permission.

Employers and Job Seekers retain ownership of content they lawfully upload, subject to the rights necessary for Dimitts to provide the Portal services.

By uploading content, a user grants Dimitts a limited, non-exclusive right to host, display, reproduce and process that content as reasonably necessary to operate and improve the Portal and provide the requested services.

 

18. USER-GENERATED CONTENT

Users are responsible for the content they upload or submit.

By submitting content, users confirm that:

• they have the right to submit the content;
• the content does not knowingly violate another person's rights;
• the content is not fraudulent or misleading;
• the content does not contain unlawful material; and
• the content does not contain malicious software.

Dimitts may remove or restrict content that violates these Terms or applicable law.

 

19. THIRD-PARTY LINKS AND SERVICES

The Portal may contain links to third-party websites, payment providers, social media platforms or other services.

Dimitts does not necessarily control or endorse those third-party services and is not responsible for their content, availability, privacy practices or terms.

Users should review the applicable terms and privacy policies of third-party services before using them.

 

20. PORTAL AVAILABILITY

Dimitts will make reasonable efforts to keep the Portal available and functional.

However, users acknowledge that the Portal may occasionally be unavailable because of:

• scheduled maintenance;
• technical failures;
• internet or telecommunications disruptions;
• cybersecurity incidents;
• third-party service failures;
• circumstances beyond Dimitts' reasonable control; or
• other operational reasons.

Dimitts does not guarantee uninterrupted or error-free access to the Portal.

 

21. SECURITY

Dimitts will take reasonable technical and organisational measures to protect the Portal and information processed through it.

However, no online platform can guarantee absolute security.

Users are responsible for maintaining appropriate security practices, including protecting their passwords and devices and promptly reporting suspected unauthorised access.

Users must not attempt to:

• gain unauthorised access to the Portal;
• circumvent security measures;
• access another user's account;
• introduce malicious code;
• interfere with Portal operations; or
• conduct unauthorised security testing.

22. DISCLAIMER

The Portal is provided as a recruitment and workforce-management platform.

Dimitts does not guarantee:

• that every job advertisement is accurate;
• that every Employer is legitimate unless expressly verified by Dimitts;
• that a particular Job Seeker will obtain employment;
• that an Employer will find a suitable candidate;
• the accuracy of information supplied by users;
• the conduct of users outside the Portal; or
• the outcome of any recruitment process.

Users are responsible for conducting appropriate due diligence before entering into employment, business or financial relationships with other users.

 

23. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Dimitts shall not be liable for indirect, incidental, consequential or special losses arising from:

• a user's use or inability to use the Portal;
• an Employer's recruitment decision;
• a Job Seeker's employment outcome;
• inaccurate information submitted by another user;
• fraudulent activities conducted by another user;
• employment disputes between Employers and employees;
• loss arising from third-party services; or
• unauthorised conduct of users.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

 

24. INDEMNITY

To the extent permitted by law, users agree to indemnify and hold Dimitts harmless from claims, losses, liabilities, damages and reasonable expenses arising from:

• their breach of these Terms;
• unlawful content they submit;
• fraudulent or misleading information they provide;
• violation of another person's rights; or
• unlawful use of the Portal.

 

25. ACCOUNT SUSPENSION AND TERMINATION

Dimitts may suspend, restrict or terminate an account where it reasonably believes that:

• the user has violated these Terms;
• the account contains fraudulent information;
• the user has engaged in unlawful conduct;
• the account poses a security risk;
• the user has abused another Portal user;
• an Employer has posted fraudulent or prohibited vacancies; or
• continued access could expose Dimitts or other users to legal, security or reputational risks.

Where appropriate and lawful, Dimitts may provide notice before termination.

Users may request closure of their accounts subject to applicable legal, regulatory, contractual and record-retention requirements.

 

26. REPORTING FRAUDULENT OR ABUSIVE ACTIVITY

Users are encouraged to report:

• fake job vacancies;
• fraudulent Employers;
• fraudulent Job Seekers;
• requests for inappropriate payments;
• impersonation;
• harassment;
• misuse of personal information;
• suspicious links or communications; and
• other violations of these Terms.

Reports may be submitted through the contact details or reporting mechanisms provided on the Portal.

Dimitts may investigate reported activities and take appropriate action.

 

27. EMPLOYMENT DISPUTES

Dimitts is not ordinarily a party to employment contracts between Employers and Job Seekers.

Any dispute concerning:

• salary;
• working conditions;
• dismissal;
• employment contracts;
• employee performance;
• workplace conduct;
• benefits; or
• other employment-related matters

should ordinarily be addressed between the relevant Employer and employee, subject to applicable law.

Where Dimitts is directly involved in a recruitment or consultancy engagement, separate contractual terms may apply.

 

28. CHANGES TO THESE TERMS

Dimitts may update these Terms from time to time to reflect:

• changes in Portal services;
• changes in technology;
• legal or regulatory developments;
• security requirements; or
• changes in business operations.

Updated Terms will be published on the Portal with the revised effective date.

Continued use of the Portal after an update constitutes acceptance of the revised Terms, to the extent permitted by law.

 

29. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.

Subject to applicable law, disputes arising from these Terms shall be subject to the jurisdiction of the appropriate courts in Nigeria.

Where appropriate, Dimitts may seek to resolve disputes through negotiation or other alternative dispute-resolution mechanisms before commencing formal proceedings.

 

30. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be modified or severed to the minimum extent necessary, while the remaining provisions shall continue to apply.

 

31. ENTIRE AGREEMENT

These Terms, together with the Dimitts Privacy Policy, applicable payment/refund policies and any additional service-specific terms, constitute the agreement governing a user's use of the Portal, except where a separate written agreement expressly applies.

33. USER ACCEPTANCE

By clicking "I Agree," "Create Account," "Register," "Post Job," "Apply Now," or by otherwise accessing or using the Portal, the user confirms that:

• they have read and understood these Terms of Use;
• they agree to comply with these Terms;
• the information they provide is accurate to the best of their knowledge;
• they will use the Portal lawfully and responsibly; and
• they understand that recruitment and employment decisions are generally made by Employers and not by Dimitts, unless Dimitts expressly acts as the recruitment provider or employer under a separate arrangement.
